Terms of Use
These Terms are an agreement between you and Hany Jiang, who personally develops and operates the Foky app from Toronto, Ontario. “Foky” is the app and product title, not a separate company.
1. Eligibility and account access
You may use Foky only if all of the following are true:
- you are at least 13 years old;
- you reside in Canada outside Quebec or in the United States;
- you can enter this agreement under applicable law; and
- your use is permitted by applicable law and by Apple account or device restrictions.
You must provide truthful eligibility information and keep it current. Foky may use Apple's Declared Age Range and PermissionKit signals and a neutral age-band declaration. If a required age or guardian signal is unavailable, declined, revoked, or ambiguous, Foky may deny account creation or freeze access. Existing accounts found to be under 13 or associated with Quebec or another unsupported region are scheduled for deletion after seven days unless eligibility is corrected; export, correction, and deletion remain available during that period.
If Foky obtains actual knowledge that an account belongs to a child under 13, it will promptly delete the child's personal information except for a minimum record needed to document deletion or comply with law; the seven-day correction period does not authorize continued product use in that situation.
An account frozen under the former 16+ minimum retains its original “under 16” band and stays denied; it is not silently reclassified or unfrozen. You may answer the age question again to correct a self-declaration. A successful eligible-age and supported-region correction cancels scheduled deletion; otherwise the existing seven-day deletion schedule remains in effect. The original answer remains in the eligibility audit history, and required Apple assurance and revocation checks still apply.
You are responsible for protecting your Apple account and your device. Do not share authentication access or attempt to use another person's eligibility status. Notify privacy@foky.app if you believe your Foky account has been compromised.
2. Teen mode
People age 13–17 receive the same reduced-pressure teen experience: ages 13–15 have the same feature permissions as ages 16–17. Teen mode includes core focus, study, Collection, deterministic progress and earned foby, focus+ subscriptions, direct earned-foby cosmetics, mutual code-based Friends, and deck sharing. Teen mode excludes AI, Pro or AI credit packs, cash foby packs, crates, ranked leaderboards, referral rewards, adult Goals, streak-loss pressure, and re-engagement nudges. These limits are enforced by the service and not only by hiding buttons.
A teen and an adult may become Friends only through the same code-based mutual acceptance flow used for all Friends. Foky has no public discovery, social feed, or chat. Apple guardian controls and PermissionKit decisions take priority where they apply.
3. Licence to use the app
Apple's Standard Licensed Application End User License Agreement governs the licence to the iOS app. These Terms additionally govern your Foky account, online services, user content, purchases, and virtual items. Subject to that standard licence and these Terms, Hany Jiang grants you a personal, limited, revocable, non-exclusive, non-transferable licence to install and use Foky on Apple devices you own or control as permitted by Apple's usage rules. Foky and its software, design, text, art, trademarks, and other materials remain owned by Hany Jiang or their respective licensors.
You may not copy, sell, sublicense, rent, reverse engineer except where law expressly permits, bypass technical restrictions, scrape, probe, interfere with, or create a competing service from Foky. Open-source components remain subject to their own licences.
4. Your content
You retain ownership of decks, cards, notes, uploaded study material, display names, and other content you provide. You give Hany Jiang a limited, worldwide, non-exclusive licence to host, copy, format, transmit, display, and process that content only as reasonably necessary to provide the feature you request, protect the service, comply with law, and enforce these Terms. This licence ends when the content is deleted, except for independent recipient-owned copies, backups awaiting rotation, and records lawfully retained for a documented purpose.
Before importing a shared deck, a recipient is told that the import creates an independent copy owned and controlled by the recipient. The sender cannot recall that copy by deleting or revoking the source. Do not share material unless you have the right to let the recipient keep an independent copy.
You promise that your content and use will not:
- infringe copyright, privacy, confidentiality, publicity, or other rights;
- include another person's personal information without authority;
- include confidential, highly sensitive, regulated, or security-secret material;
- be unlawful, deceptive, threatening, harassing, hateful, sexually exploitative, or abusive;
- promote self-harm, violence, illegal activity, or exploitation;
- contain malware, credentials, access tokens, or instructions to compromise systems; or
- be submitted to AI when you lack the right to send it to Anthropic for processing.
5. Friends, reports, and blocking
Friends are mutual and code-based. Do not use codes, names, or shared study content to harass, groom, exploit, impersonate, deceive, or contact someone who does not want contact. Foky may filter display names and shared text, rate-limit actions, remove content, dissolve connections, suspend accounts, or report conduct where reasonably necessary for safety, security, or law.
Blocking ends the friendship, pending requests and shares, and future visibility in both directions. Reports may concern a user, share, or content and may include an optional snapshot only when the reporter expressly chooses it. Reports are reviewed under the published Safety process. Foky is not an emergency service.
6. Focus and Family Controls
Foky can use Apple's Family Controls to shield apps or websites you select. You remain responsible for your device, schedule, emergency access, and safe use. Do not configure Foky in a way that prevents access to emergency, health, safety, work, school, accessibility, or legally required resources. Native controls and operating-system behaviour may fail, change, or be unavailable. Foky does not guarantee that blocking will prevent every distraction or produce a particular educational, health, or productivity result.
Guided unlock is a focus+ feature on one account, owned by the person using Foky. A trusted adult may hold the six-digit Strict PIN. Whoever holds that PIN can open the unlock-terms screen to set the number of correct answers and the length of a quick peek, and optionally write the questions. The PIN also gates turning Strict mode off and deleting a Strict profile. Foky does not verify the PIN holder's identity, collect their name, email, relationship, or account information through this feature, or provide a parent account, second sign-in, parent-facing view, remote access, or supervision report.
Authored questions and answer choices stay in ordinary on-device app storage. They are not encrypted by Foky, synced, sent to Foky's server, or placed in the App Group used by the shield extension. They are cleared with the applicable blocking settings. An empty authored set falls back to your own due cards. Guided unlock configures non-Strict quick peeks; Strict mode permits no temporary pass. If paid access ends, saved terms remain but effective terms return to one due card for five minutes and paid Strict and scheduling controls stop applying. Deleting the app or revoking Screen Time authorization ends blocking. These features add friction; they cannot guarantee supervision or prevent removal of the block.
7. Artificial intelligence
AI features are optional and restricted to adults whose 18+ status is established. Before each request, Foky identifies what will be sent to Anthropic at the point of action. Pressing that action starts processing without another confirmation dialog; opening the screen sends nothing. AI output may be inaccurate, incomplete, biased, offensive, or fabricated. Review it before use.
Foky and its AI output do not provide medical, legal, financial, mental-health, safety, academic-integrity, or other professional advice. Do not rely on AI output for high-stakes decisions, diagnoses, emergencies, or as a substitute for a qualified person or an original source. You are responsible for how you use, edit, share, or submit generated content.
8. Subscriptions and in-app purchases
Purchases are processed by Apple and entitlement status is supported by RevenueCat. Prices, billing periods, trial terms, taxes, and renewal details shown by Apple at purchase control. Focus+ currently offers monthly and annual plans; the price displayed in the app comes from the App Store. Subscriptions renew automatically unless cancelled through Apple at least as required by Apple's current rules. Deleting Foky or your Foky account does not itself cancel an Apple subscription.
Teen accounts may purchase focus+ through the App Store account. Apple's purchase restrictions and Ask to Buy apply where enabled or required by Apple; Foky does not operate a separate adult payment or approval account. Holding the Strict PIN does not authorize a purchase.
Restore Purchases attempts to restore valid Apple purchases. Refund requests and billing disputes are handled through Apple except where applicable law requires another remedy. Nothing in these Terms limits a mandatory consumer right, statutory warranty, refund, or cancellation right that cannot lawfully be excluded.
9. Foby, cosmetics, and crates
Foby is a virtual in-app unit with no cash value. It is not money, stored value, cryptocurrency, property, or a promise of future value. It cannot be redeemed, transferred, sold, wagered, or exchanged outside Foky. Cosmetics are digital presentation items and do not provide competitive power. Foky may correct balances affected by error, fraud, chargeback, or refund. A refund adjustment is applied to the original currency source and may create a non-spendable debt in that source until future matching grants cover it.
Server records distinguish effort foby earned through verified focus, reviews, approved deterministic bonuses, or crate conversion; purchased foby from verified packs; and promotional foby from manual or support grants. For adults, direct cosmetics spend purchased, then promotional, then effort foby. Teen accounts may spend only effort foby on direct cosmetics. Cash foby packs are available only to adults.
Crates are an adult-only, optional randomized Collection reveal. A crate may be obtained only through an explicit action that spends eligible effort foby; purchased or promotional foby cannot buy a crate. Crates, their keys or chances cannot be bought for cash, supplied by a subscription, transferred, resold, or redeemed. A crate awards one eligible Collection item the account does not already own. Before confirmation, Foky displays the actual current server-derived probabilities and eligible-item counts. While every rarity remains available, the crate curve is 65% sprout, 28% glimmer, and 7% wonder, split equally among eligible items in each rarity; completed rarity tiers are redistributed across the remaining tiers. When the configured Collection pool is complete, the disclosed crate outcome is 100 effort foby in return for a 120-effort-foby cost. Collection items and foby have no cash value.
10. Availability, changes, and suspension
Foky may change, pause, or discontinue features to maintain security, comply with law or platform rules, prevent abuse, or improve the product. Online features depend on networks and third-party services. No uninterrupted, error-free, or permanently available service is promised.
Hany Jiang may restrict or suspend access for a material or repeated breach, safety risk, fraud, unlawful activity, provider requirement, or threat to the service. Where reasonable, Foky will give notice and a chance to correct or appeal. Urgent safety and security action may occur without advance notice. Export and deletion remain available where safe and legally required.
11. Privacy and changes to these Terms
The Privacy Notice explains Foky's information practices. The current Terms are always available at /terms, and this version remains at /terms/v2/. Version 1 remains available at /terms/v1/. Material changes require versioned acceptance. Where Apple requires adult notice, guardian approval, or a verified significant-change signal for a teen, Foky will not make the changed feature available until the required path is implemented, verified, and resolved.
12. Disclaimers
To the maximum extent permitted by law, Foky is provided “as is” and “as available.” Hany Jiang disclaims implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted operation. These disclaimers do not exclude a warranty or condition that applicable consumer law makes mandatory.
13. Limitation of liability
To the maximum extent permitted by law, Hany Jiang will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, opportunity, goodwill, productivity, or access, arising from Foky or these Terms, even if the possibility was known. To the maximum extent permitted by law, aggregate liability for all claims relating to Foky will not exceed the greater of CAD $100 and the total fees you paid for Foky in the 12 months before the event giving rise to the claim.
This section does not limit liability for fraud, wilful misconduct, gross negligence, death or personal injury where it cannot lawfully be limited, breach of a non-waivable privacy or consumer right, or any other liability that law does not permit the parties to exclude or cap. Some jurisdictions do not allow particular exclusions, so only lawful limits apply to you.
14. Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer right to bring a claim elsewhere, the courts located in Toronto, Ontario have exclusive jurisdiction. These Terms do not require arbitration and do not waive a right to participate in a class proceeding where that right exists.
Before filing a claim, you and Hany Jiang agree to try in good faith for 30 days to resolve it by written notice, unless urgent relief or a limitation period makes that impractical. Send notice to privacy@foky.app with enough detail to understand the issue.
15. General terms
If a provision is unenforceable, it is limited or removed only as much as necessary and the rest remains effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without written consent. Hany Jiang may transfer them only with the service or as permitted by law, with any required notice. Headings are for convenience. The English version controls; Foky also offers a Simplified Chinese interface, but the legal documents and binding acknowledgements remain in English. These Terms, the Privacy Notice, and purchase terms shown by Apple form the agreement about Foky, subject to mandatory law.
